Terms of Service
These Terms are the agreement between your business and 1001790863 Ontario Inc., operating as Trillium Websites (“Trillium Websites”, “we”, “us”), for the Trillium Websites website editor and hosting service. They include the Data Processing Schedule and, once text alerts are available, the Text-message alert terms. Our Privacy Policy explains how we handle personal information.
1. Who these Terms are for
The service is for businesses located in Canada, outside Quebec; it is not offered to businesses located in Quebec. You accept these Terms when you select “Claim this website” (or “Request access”) next to a statement that refers to them. By doing so you confirm that you own the business named on the website or are authorized to act for it, and that you accept these Terms for it. “You” means that business and the people it lets use its account.
2. The service
We prepare a website proposal and let you claim it, or build the first draft of your website from your answers when you start one yourself at app.trilliumwebsites.ca/start; we give you an editor to change it in plain language or with forms, host it, publish the version you approve, deliver visitor enquiries to you by email, and let you connect a domain you own. The AI editor is optional; every field can also be edited with the forms.
3. Free and paid use
Claiming a website, editing it and reviewing it in preview are free and never turn into a paid plan by themselves. Payment starts only when you complete a separate subscription checkout. Paying never publishes a version you haven't confirmed: a version is published only when you confirm its publication (“Launch site”, “Publish” or “Publish this version”). The free public preview is available once, for up to 30 days: a version published before paying is shown in preview at its public address for up to 30 days, then taken offline until you subscribe; your content stays saved. It is available once per website, per business account and per person: unpublishing, republishing, publishing another version or another website, or ending a subscription doesn't start a new one. Paying makes your confirmed version live. You can unpublish your website at any time in Launch & billing; unpublishing doesn't cancel a subscription. A website you build yourself at app.trilliumwebsites.ca/start has no free public preview: building, editing and reviewing it in your private preview are free, and publishing it at its public address needs a subscription. Until you subscribe, AI editing on it is limited to a small one-time allowance, shown in the editor as the AI edits left; after you subscribe, the daily allowance applies.
4. Prices and taxes
- Monthly: $49 CAD per month.
- Yearly: $468 CAD per year, charged in one payment each year (equivalent to $39 per month).
Prices are in Canadian dollars and are plus tax: GST/HST (and any provincial sales tax that applies) is added on top and shown, with the total and any credit, on the Stripe checkout page before you pay. Payments are processed by Stripe.
Checkout is only for businesses located in Canada outside Quebec: you need a Canadian billing address outside Quebec and a card issued in Canada. If a subscription is paid with a billing address or card from anywhere else, we cancel it straight away, refund the payment in full and tell you by email; nothing is published on it.
If we change a price, we will email you between 7 and 30 days before the new price applies to your subscription. The change takes effect at your next renewal after that notice, and you can cancel before then.
5. Renewal and cancellation
Your subscription renews automatically at the end of each month or year, on the renewal date shown in Billing, and your saved payment method is charged the price of your plan plus applicable tax, until you cancel. When you subscribe we email you an acknowledgment with the plan, the amount, the billing interval and your next renewal date.
- Yearly plans: we email you a reminder about 30 days before each renewal, with the date, the amount and how to cancel.
- Monthly plans: we email you once a year to remind you that the subscription continues, with the amount of the next charge and how to cancel.
- How to cancel: in the editor, open Launch & billing and select Cancel subscription, then confirm once. No call or survey is needed. You can also cancel in the Stripe billing portal (Manage subscription). To avoid the next charge, cancel before the renewal time stated in Billing and in your reminder.
- What cancellation does: it stops future renewals immediately. Your website stays published until the end of the period you paid for, then goes offline until you subscribe again; your content stays saved. We email you a confirmation with the date hosting ends.
- Cancelling after a failed payment: if a payment has failed and hasn't been paid yet, cancelling ends your subscription straight away instead, and we stop retrying the payment, so you aren't charged after you cancel. Your website goes offline at once; your content stays saved, and you can subscribe again at any time. We email you a confirmation.
- Switching plans: you can switch between monthly and yearly in Manage subscription. Moving to yearly is charged straight away, less the unused part of your current month; moving to monthly takes effect when your current year ends.
6. Failed payments
If a renewal payment fails, your website stays published for 14 days from the first failed payment while you update your payment method in Billing. After that, the website and its enquiry form pause (visitors see that the website isn't live) until the subscription is paid. You can also cancel instead (see section 5).
7. Refunds
- First payment: you can ask for a full refund of your first subscription payment within 14 days of that payment. Email [email protected] from your account email. A refund ends the subscription, and your website goes offline.
- Later payments: we do not give prorated refunds when you cancel; you keep the service until the end of the paid period.
- Exceptions: we refund where the law requires it, when we charged you in error, or when we failed to provide the service you paid for.
8. What we provide, and its limits
We host your website, keep the editor and publishing working, and answer support requests by email at [email protected]. The AI editor has a daily allowance (shown in the editor, reset at midnight Eastern time); a website you built yourself has the one-time allowance in section 3 until you subscribe. We work to keep the service available but do not promise it will be uninterrupted or error-free; planned maintenance and outages of our providers can affect it.
We do not guarantee search rankings, traffic, enquiries, leads, sales or revenue. Search engines decide whether and how they list your website.
9. AI-generated content
AI suggestions and the starting content we write can be inaccurate, can resemble content made for others and are not exclusive to you. Review everything before you publish it. Nothing the service produces is legal, medical, financial or other professional advice, and we do not confirm that your website meets the advertising rules of your profession or licensing body.
10. Your content and your responsibilities
You are responsible for what your published website says. In particular:
- you have the rights to the text, photos, logos and other material you add;
- business claims, credentials, licences, prices and service areas are accurate and current;
- testimonials and reviews are real, used with permission, and not edited to mislead;
- your website follows the advertising and professional rules that apply to you;
- the website's Privacy Notice (which we generate from your details) is accurate for how you handle enquiries; review it before you publish and tell us if your practices differ, for example if you copy enquiries into another tool;
- you do not ask visitors to send payment card numbers, health information, government ID numbers or confidential documents through the enquiry form.
We are responsible for the proposal we prepared before you claimed it. Once you claim and publish a website, you are responsible for reviewing it, including content we wrote.
11. Acceptable use
You may not use the service for unlawful content; to infringe anyone's rights; to impersonate a person or business; for phishing, malware, spam or deceptive practices; to harass anyone; to interfere with or probe the service's security; or to collect patient records, privileged client material or sensitive identifiers through forms or AI requests.
12. Ownership and licences
- Your content stays yours. You let us host, copy, display, adapt and transmit it as needed to provide the service, and to show it in your website's previews.
- Copy we write for your website: to the extent we have rights in it, we assign them to you once you claim the website. Purely AI-generated material may not be protected by copyright at all, so we cannot promise exclusive rights in it.
- What we keep: the editor, the templates, the design system, the software and our image library. Images from our library come with a non-exclusive licence to use them on your website. The library images are illustrations, not photos of your business.
13. Your content after the service ends
Until 30 days after your service ends, you can ask for a copy of your website's text and the photos you uploaded by emailing [email protected]. We prepare it by hand. It is a copy of your content, not a working website or our software.
14. Suspension and termination
We may suspend a website or account immediately when there is a credible security risk, unlawful content, or a risk of harm to others. For ordinary problems, such as an unpaid subscription or another breach of these Terms, we will tell you and give you a reasonable chance to fix it first. We restore service once the issue is resolved.
You can stop using the service at any time by cancelling your subscription. We may end the service with 30 days' notice, and immediately for serious or repeated breaches. When the service ends, your website stops being published; your content export rights in section 13 still apply, and we delete your account and content when you ask us to, subject to records we must keep.
15. Copyright complaints
We respond to notices of claimed copyright infringement under our Copyright Notice Policy, which follows Canada's notice-and-notice regime.
16. Referral program
- You earn one month at your plan's rate for each business you refer that becomes a paying Trillium Websites customer and stays paid for 14 days after its first payment.
- On the monthly plan, your next monthly invoice is free; several months are used one invoice at a time. On the yearly plan, $39 (one month at the yearly rate) comes off your next yearly renewal for each month earned, up to 12 months on one renewal; any extra carry over to the next. If you are not subscribed yet, months wait for your first renewal.
- One month per referred business, whoever referred them first. Your own business, another account of yours, and businesses that share your email or payment card do not count.
- Earned months have no cash value and cannot be exchanged or transferred. We may decline or cancel a referral we believe is abusive.
- Only refer people who are happy for us to contact them about a website. When you recommend us, tell them you may earn a reward.
17. Domains
You can connect a domain you already own (a www or other subdomain address) once your subscription is active. You stay the domain's registrant and remain responsible for renewing it with your registrar; ending our service never takes your domain from you. Buying a domain through us is not offered yet; separate terms will apply before it is.
18. Disclaimers and limits of liability
Except as these Terms say otherwise, the service is provided “as is”. To the extent the law allows:
- our total liability for all claims about the service is limited to the greater of $100 CAD or the fees you paid us in the 12 months before the claim arose;
- neither of us is liable for indirect, consequential or special losses, or lost profits, revenue or data.
These limits do not apply to fraud, wilful misconduct, or liability that cannot be limited by law.
19. Indemnity
You will cover our reasonable costs of claims by others that arise from your content or from your use of the service in breach of these Terms.
20. Changes to these Terms
The version and effective date are at the top. We will tell account holders about material changes by email or in the editor at least 30 days before they take effect (price changes follow section 4). Changes do not apply retroactively. If you do not agree to a change, you can cancel before it takes effect.
21. Law and disputes
These Terms are governed by the laws of Ontario and the federal laws of Canada that apply there, and the courts in Ottawa, Ontario have jurisdiction, except where the law of your location gives you rights that cannot be waived.
22. Notices and contact
We send notices to the email address of your account. Send notices to us at [email protected] or by mail to: 1001790863 Ontario Inc., operating as Trillium Websites, [TO FILL: Trillium Websites mailing address, Canada] (mailing address). Support: [email protected].
23. General
These Terms, with the documents they refer to, are the whole agreement about the service. If part of them is unenforceable, the rest still applies. Neither of us is responsible for delays caused by events beyond reasonable control. You may not transfer this agreement without our consent; we may transfer it to a successor of our business. Failing to enforce a term is not a waiver of it.
Schedule A — Data Processing Schedule
This schedule applies when we process personal information on your behalf to provide the service, mainly enquiries sent through your website. You are responsible for the information and decide why it is used; we act on your instructions, which are these Terms and the settings you choose in the editor.
- Subject matter and purpose. Hosting your website and delivering enquiries from its visitors to you, keeping the service secure, and providing support.
- Duration. For as long as we host your website, plus the retention periods below.
- People and information. Your website's visitors who send an enquiry: name, email address and/or phone number, message, the page it was sent from and a salted one-way code of the network address. People named in your website's content: whatever you choose to publish about them.
- What we do with it. Only what is needed to host your website, deliver enquiries by email (and, once available and if you turn them on, by text message), keep the service secure and answer support requests. We do not sell it, use it for advertising, combine it with other data for our own purposes, or use it to train AI models. If you use the AI editor, your website's content is sent to the AI providers listed in the Privacy Policy under zero-data-retention terms.
- Confidentiality and security. Only people who need access to run the service can access it, and they must keep it confidential. We use access controls, encrypted connections and our providers' security features.
- Subprocessors. We use the providers listed in our Privacy Policy (Supabase on AWS in Canada, our application server in the United States, Cloudflare, Resend, Google Workspace, and Twilio once text alerts are available), under contracts that protect the information. We will email you at least 15 days before adding or replacing a provider that processes enquiries; if you object, you can cancel your subscription before the change.
- Help with requests. We will help you answer requests from people to see, correct or delete their information, and forward to you any such request we receive about your website.
- Incidents. We will notify you without undue delay after we become aware of a breach affecting this information, tell you what we know, help you meet your obligations, and take reasonable steps to contain it.
- Return and deletion. We remove an enquiry's name, contact details and message 30 days after delivery and delete the rest of its record 90 days after it was received. Text-message alert records are deleted after 30 days. Deleted information can remain in backups for up to 30 days. When the service ends you can ask for the enquiry data we still hold before it is deleted on that schedule.
- Information and audits. We will answer reasonable written questions about how we protect this information, once a year or after an incident.
Schedule B — Text-message alert terms
This schedule applies once text-message alerts are available in the editor; they are not yet active.
- The program: Trillium Websites enquiry alerts. If you turn it on, we text the mobile number you confirm when your website receives an enquiry; each text includes the visitor's name, phone number or email address and the start of their message. We also text a code to confirm the number.
- Consent: texts are sent only after you tick the opt-in box and confirm the number. Texts are optional; enquiries are always delivered by email as well.
- Frequency and cost: message frequency varies with the number of enquiries. Message and data rates may apply.
- Stopping and help: reply STOP to stop texts, or HELP for help, or turn the setting off in the editor. Email [email protected] for support.
- Carriers are not liable for delayed or undelivered messages.
- Your number: we use it only for these alerts. We do not sell mobile numbers or opt-in information or share them with others for their marketing.
